Wills, Probate & Lasting Power of Attorney

Who needs to make a will?
Planning your estate and making a professional Will is one of the most important things you will ever do. By protecting your hard earned wealth and assets, and putting them in order, you can protect the people that matter to you the most.
Whatever your circumstances, to die Intestate (without having made a Will) leaves your loved ones in an uncertain and stressful position. Putting your affairs in order is one of the most important tasks you are likely to undertake.
What is a Probate?
Probate is the process of dealing with the estate of someone who has died, which generally means clearing their debts and distributing their assets in accordance with their will. Technically, 'probate' refers to getting permission to carry out the wishes within someone's will, though the term also applies to the whole process of settling someone's estate. If you're responsible for executing someone's will, as an executor, there are specific rules that set out how you notify the authorities and distribute the estate.
Sometimes a loved one may die without having left a Will, however their estate must still be dealt with according to the Law. To ensure that your wishes and/or those of your loved ones are adhered to and in accordance with the rules and laws of probate, it is standard and a worthwhile practice to appoint a professional and experienced firm.

Lasting Power of Attorney (LPA) ?
A Lasting Power of Attorney is a very beneficial legal document and is usually seen as the final piece of the profess in planning and protecting your estate. Through this legal document you can appoint who you wish to manage your affairs and estate should you become mentally incapable of managing them yourself. If a Lasting Power of Attorney has not been drawn up, joint assets can be frozen while your family applies to the Court of Protection for a procedure known as receivership – an expensive and cumbersome process.
